Mastering Pharmacy Law for the MPJE: An Overview on how to Support DEA Inquiries

Pharmacists play an important role in maintaining the integrity of the controlled substance supply chain, and as such, they may be subject to inquiries from the Drug Enforcement Administration (DEA). If a DEA agent contacts a pharmacist, it is important for the pharmacist to respond in a professional and cooperative manner.

Here are some steps a pharmacist can take in response to a DEA inquiry:

  1. Verify the identity of the DEA agent: Ask for a government-issued identification card and confirm that the agent is authorized to conduct an inquiry on behalf of the DEA.

  2. Request a written request for information: If the DEA agent is requesting information or access to records, ask for a written request that specifies the scope and purpose of the inquiry.

  3. Consult with counsel: If the DEA request raises legal or compliance concerns, it may be necessary to consult with legal counsel before providing any information.

  4. Review applicable laws and regulations: Ensure that you are aware of and comply with all applicable federal and state laws and regulations, including HIPAA privacy laws, regarding the release of patient information.

  5. Provide the requested information: If the DEA request is legally valid and the information being requested can be legally disclosed, provide the requested information in a timely and accurate manner.

It is important to keep accurate and detailed records of any interactions with the DEA, including the date and nature of the inquiry and any information provided in response.

By responding in a professional and cooperative manner, pharmacists can help to maintain the integrity of the controlled substance supply chain and protect the public health
